By utilizing the Ketchup service ("Service" or "Services"), you consent to be governed by the following terms and conditions ("Terms of Service").
Ketchup ("Company") reserves the right to update and change these Terms of Service without notice. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
These Terms form a binding contract between you and Ketchup. To use the Services, you must accept all Terms. Use of the Services in any capacity signifies your agreement to these Terms, which remain effective as long as you use the Services. This includes the terms in this document as well as those in the Privacy Policy.
Account Terms
- You are responsible for the security of your account and password. Ketchup cannot be liable for any loss or damage resulting from your failure to protect your account information.
- All activities under your account are your responsibility, including actions taken by others who have access to your account.
- The Service must not be used for illegal purposes or to infringe upon laws in your jurisdiction.
- Accounts must represent individuals; automated methods of registration are not permitted.
- The Service should not be used to spam Farcaster or engage in behavior deemed as spamming, including publishing similar posts in bulk.
Use Restrictions
You agree not to misuse the Services in ways that infringe on rights, violate laws, or interfere with others' use of the Service, among other restrictions outlined herein.
- You represent, warrant, and agree that you will not contribute content to the Service or otherwise use the Services or interact with the Services in a manner that infringes or violates the intellectual property rights or any other rights of anyone else (including the Company).
- Violates any law or regulation, including, without limitation, any applicable export control laws.
- Is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable.
- Jeopardizes the security of your account or anyone else’s (such as allowing someone else to log in to the Services as you).
- Attempts, in any manner, to obtain the password, account, or other security information from any other user.
- Violates the security of any computer network, or cracks any passwords or security encryption codes.
- Runs Maillist, Listserv, any form of auto-responder, or “spam” on the Services, or any processes that run or are activated while you are not logged into the Services, or that otherwise interfere with the proper working of the Services (including by placing an unreasonable load on the Services’ infrastructure).
- “Crawls,” “scrapes,” or “spiders” any page, data, or portion of or relating to the Services or Content (through use of manual or automated means).
- Copies or stores any significant portion of the Content.
- Decompiles, reverse engineers, or otherwise attempts to obtain the source code or underlying ideas or information of or relating to the Services.
A violation of any of the foregoing is grounds for termination of your right to use or access the Services.
Copyright and Content Ownership
The Company does not pre-screen content, but reserves the right (but not the obligation) in their sole discretion to refuse or remove any content that is available via the Service.
The visual design, HTML, CSS, and JavaScript elements of the Service are copyrighted by Ketchup and are protected. Duplication or reuse without express permission from Ketchup is prohibited.
General Conditions
We are in public alpha phase and expect bugs in our systems. Your use of the Service is at your sole risk.
The Service is provided "as is". We provide technical support for Service issues through email and our support channels.
Your use of the Service indicates acceptance of these terms, including future updates and modifications.
- Technical support is only provided via email, via in-app chat when available.
- You understand that the Company uses third-party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service.
- You must not modify, adapt or hack the Service.
- You must not modify another website so as to falsely imply that it is associated with the Service or the Company.
- You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by the Company.
- We may, but have no obligation to, remove content and accounts that we determine in our sole discretion are unlawful, violate any party’s intellectual property or these Terms of Service, or we believe to use the Service to spam other users or services.
- Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Service customer, Company employee or officer will result in immediate account termination.
- You understand that the technical processing and transmission of the Service, including your content, may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
- We reserve the right to temporarily disable your account if your usage significantly exceeds the average usage of other Service customers.
- The Company does not warrant that (i) the service will meet your specific requirements, (ii) the service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the service will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and (v) any errors in the Service will be corrected.
- You expressly understand and agree that the Company shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, resulting from the use or the inability to use the service or any other matter relating to the service.
- The failure of the Company to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and the Company and govern your use of the Service, superseding any prior agreements between you and the Company.
Payment Terms
To use a paid account, you must have a valid method of payment. We charge payments upfront each month, and these are non-refundable.
This means we don't offer refunds or credits for partially used service periods, changes in your service plan, or for any time left unused if your account remains open.
Privacy and Security of Your Data
Ketchup is dedicated to the privacy and security of your data, employing various security measures to protect your information. Refer to our Privacy Policy for more details.
Cancellation and Termination
Cancellation must be done through the provided means within the Service. Upon cancellation, all data associated with your account will be permanently deleted.
An email or phone request to cancel your account is not considered cancellation.
Liability
Ketchup is not liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if the Service has been advised of the possibility of such damages), resulting from the use or the inability to use the service.
